Conversion Therapy Ruling Appealed in California

A Virginia-based evangelical Christian organization is seeking an emergency hearing in the 9th District Federal Court of Appeals in San Francisco to stop the Jan. 1 implementation of California’s first-in-the-nation ban on conversion therapy for minors.

Liberty Counsel, which is affiliated the Jerry Falwell’s Liberty University in Lynchburg, Va., asked for the hearing following a decision by U.S .Federal Judge Kimberly J. Mueller that the law could go into effect Jan. 1. That ruling followed by a day a decision by another federal court judge in Sacramento that the new law was an unconstitutional infringement on free speech.

But Judge William B. Shubb said his ruling applies to only the three plaintiffs who had challenged the ban until he can hold a full hearing. However, the judge indicated that “the plaintiffs are likely to succeed” and that if his interpretation of the law is upheld on further appeal, the ban would be overturned.
